Driving under the influence in Santa Barbara

Being that our own beautiful Santa Barbara is the city with the most DUI (Driving Under the Influence) arrests per capita in California, according to the California Office of Traffic Safety, I saw it fitting to write about the topic. In this state it is illegal to drive a motor vehicle under the influence of alcohol; technically with a blood alcohol level of .08 or higher. This translates on average to approximately 1 drink per hour.
Of course the best defense to a DUI is not to get behind the wheel within 12 hours of drinking any alcohol. But if you find yourself in a position where you are behind the wheel and are about to be confronted by a law enforcement officer, here are some tips to help protect your civil rights.
Many experts will tell you to simply give the officer your license, registration and proof of insurance and not answer any of his or her questions. The truth is you really don’t have to talk to a police officer if you don’t fell like it; it is your constitutional right. The less you say the less evidence the officer will have to arrest you.
It is also your right to reject the so called breathalyzer test. Unless you are under 18 years old, you do not have to blow into any devise. Opt for a urine or blood test; these will leave evidence that can be re-tested and re-verified.
Please keep in mind that law enforcement officers are out there to protect the safety of the public, and if you are driving with an alcohol level of .08 of higher, you deserve to be arrested and booked.

Comenzando por el hecho que nuestra bella Santa Bárbara es la ciudad con el mayor número de arrestos por DUI (conducir bajo el efecto del alcohol) per capita en todo el estado, de acuerdo a California Office of Traffic Safety, vi que era combeniente hablar de este tema
Legalmente en este estado es ilegal conducir un vehículo automotor bajo la influencia de bebidas alcoholicas con un nivel de alcóhol en la sangre de 0.08 o superior. Lo que es lo mismo a no tomar más de una bebida por hora.
Por su puesto, que la mejor defensa para un DUI es no es estar detrás del volante en un lapso de 12 horas luego que se haya embriagado. Pero sí algún día está en la situación donde usted condujo en estas condiciones y está cerca de ser confrontado por un oficial de policía, aquí hay algunos concejos que le ayudarán a proteger sus derechos.
Muchos expertos le dirán que simplemente le de su licencia, la registración y la prueba del seguro del auto y que no conteste a ninguna pregunta que el oficial le haga. Es verdad que no tiene que hablar al policía sino quiere hacerlo, porque es su derecho constitucional. Entre menos le dija, menos evidencia tiene el agente para arrestarlo.
Es además, su derecho el negarse a lo que se llama el breathalyzer test o test de aliento. A menos que usted sea menor de 18 años, usted no tiene que soplar ningún aparato. Mejor opte por un exámen de orina o uno de sangre, estos dejarán evidencia que puede ser verificada y que le dan la opción para que usted pueda tomar otra prueba.
Por favor mantenga en mente que los oficiales de polícia están para proteger la seguridad de la comunidad, y que sí usted es agarrado conduciendo con níveles de alcóhol al 0.08 o superiores, significa que sí merece que lo multen y lo encarcelen.
